1. Acceptance of Terms
By accessing and using EYE RX CRAFT (the "Application"), you agree to be bound by these Terms of Service. This is a legally binding agreement between you, the licensed eye care professional, and EYE RX CRAFT. If you do not agree to these terms, please do not use our services.
2. Eligibility and Professional Use
The Application is strictly a Business-to-Professional (B2B) tool designed for certified Optometrists, Ophthalmologists, and clinical staff. By registering, you warrant that:
- You hold a valid license to practice eye care in your jurisdiction.
- You are authorized to handle sensitive patient health information.
- You will use the AI clinical tools only as assistance to your own professional judgment.
3. Data Ownership and Privacy
You own your patient data. EYE RX CRAFT acts as a Data Processor, providing the infrastructure to store and manage your clinical records. You are the Data Controller and are responsible for obtaining patient consent and complying with local health data laws (e.g., GDPR, HIPAA, or India's DPDP Act).
4. Clinical AI and Accuracy
The Application provides AI-driven diagnosis suggestions, prescription translations, and clinical alerts. You acknowledge that:
- AI suggestions are advisory only and must be verified by you before finalization.
- EYE RX CRAFT is NOT a diagnostic medical device.
- The final prescription issued to a patient is your sole legal responsibility.
5. Subscription and Billing
Access to certain features or patient registration limits is governed by your subscription plan. While we may offer open-access periods, we reserve the right to enforce quotas based on your hospital's tier. All fees are non-refundable unless required by law.
6. Termination
We reserve the right to suspend or terminate accounts that violate medical ethics, misrepresent credentials, or fail to maintain secure login practices. Upon termination, you may request a final export of your clinical data before permanent deletion.
7. Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in West Bengal.
